To ensure you maximise the convenience of online ordering please remember:

Alcohol purchases must be signed for by someone over the age of 18 on delivery.  Our staff will insist on age verification if you “look” 25 years of age or younger – it’s a judgement call so please be flattered if they ask – it’s not our intent to offend!

In NZ it is against the law to leave restricted goods such as alcohol unattended at an address. Please make sure that someone will be available to take delivery at the requested time because we will not leave it on the door step!
If you have any questions and queries, please call the store that your order was sent to. Your electronic confirmation email will tell you both the store and their telephone number. They will know the most about your order status.

Delivery Times

Delivery days are available Monday to Saturday – we don’t deliver Sundays and public holidays where it is illegal to trade. There are 2 delivery time windows - 10am-1pm and 1pm to 5pm. Orders received between 10.01am and 5.00pm can be delivered no earlier than 10am-1pm next day. Orders received between 5.01pm and 10.am can be delivered no earlier than the next 1pm-5pm window.

Delivery Costs

There are different delivery costs depending upon the proximity of the delivering address to the respective delivering store. A zoning mechanism is used. The delivery zone is determined by the suburb entered for the delivery.

Within local delivery zone a flat fee of $10 applies to deliveries where the order cost is under $100.Delivery is free for orders that cost $100 or more – where the total cost of the order is being delivered to a single address. There is no minimum order value for delivery.

Outside local delivery zone.The minimum out of zone delivery charge is $10. The maximum is $50.Delivery charges are based on Multiples of 12 for bottles of wine or spirits - $10 per 12 tems (can be made up of a mix); and Multiples of 24 for beer and RTD products (can be made up of a mix) - $10 per 24 items. Pick up is also available - based on same times as delivery - am and pm options from all stores – there is no charge for pick-up orders.

Split Deliveries

Available to all users check out enables users to split out delivery of orders within a single purchase. Registered users are able to save multiple delivery addresses and select which one(s) to use as part of the check out process. Users are able to send part of an order to one delivery address and another part of the order to different delivery address. In this scenario, delivery costs are applied on an individual basis and in accordance with the delivery cost rules below, i.e. assuming local zone delivery - if the total order cost is $120 and $30 of that is being delivered to a different address, then the charges for the $90 and the charges for the $30 will apply.

Returns Policy

If you are unhappy about any aspect of your delivery or would like to return any part of your order please contact your delivering store with all details of your order and what is required. Liquor King offers a 20% sale or return policy. This means that you can have piece of mind if you over order that some product can be unopened. Product returned must be in re-saleable format – ie wine, beer, spirit or RTD packaging unbroken from original format and not damaged in any way We will then arrange either a replacement or refund. Claims must be made within 7 days of receipt of goods.

Information Collection and Use

Liquor King is a division of Lion Liquor Retail Ltd, a wholly owned subsidiary of Lion Nathan Ltd. Lion Nathan Ltd is the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. Liquor King collects information from our users at several different points on our lk.co.nz website.

Registration

No registration is required in order to use this website, though a user may choose to become a member to take advantage of ‘member only’ offers and services. During membership registration a user is required to give their name, date of birth, email address, and a password. This information is used to contact the user about the services on our site for which they have expressed interest.

Ordering

We request information from the user on our order form. Here a user must provide contact information (like name and shipping address) and financial information (credit card number, expiration date, billing address, and billing phone number). If we have trouble processing an order, this contact information is used to get in touch with the user. This information is taken in a secure area, is encrypted for our customers' protection, and is not sold or shared with anyone else under any circumstances.

Cookies

A cookie is a piece of data stored on the end-user's hard drive containing information that relates directly to the end-user's visit to our web site. Any information placed in the cookie is accessible ONLY to Liquor King, and will NOT be sold or shared with anyone else under any circumstances. We use a cookie to store a unique session identifier, and this allows us to maintain your shopping cart and state selection from one page request to the next. We are also able to maintain your session information from one visit to the next. By setting a cookie on our site, the user would not have to log in more than once, thereby saving time while on our site. If a user rejects the cookie, they may still browse our site, but the user will be unable to log in or make a purchase. Log Files

We use IP addresses to analyse trends, administer the site, track user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

Sharing

We will share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can identify any individual person.

This web site contains links to other sites. Please be aware that Liquor King is not responsible for the privacy practices of such other sites. Newsletter

If a user wishes to subscribe to our newsletter, we ask for contact information such as name and email address. If at any time you should wish to unsubscribe, simply send an email to our friendly Customer Care representatives with your request and the account name you used to create your account. Every e-mail that we send provides you with the opportunity to unsubscribe from the newsletter service.

Surveys & Contests

From time-to-time our site requests information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose information. Information requested may include contact information (such as name and shipping address), and demographic information (such as geographic region, age level). Contact information will be used to notify the winners and award prizes. Liquor King may use this information for marketing opportunities if authorized by the registrant, and will also be used for purposes of monitoring or improving the use and satisfaction of this site.

Correcting/Updating Personal Information:

If your personally identifiable information changes (such as your shipping or billing address, your preferred credit card, etc.), you can add new information or delete any addresses or credit cards from the ‘my account’ page, located on the left hand menu, once you have logged in. Notification of Changes

If we decide to change our privacy policy, we will post those changes on our Homepage so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we may disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an email. Users will have a choice as to whether or not we use their information in this new manner. We will use information in accordance with the privacy policy under which the information was collected.

Security

When our order form asks users to enter sensitive information (such as credit card number and/or social security number), that information is encrypted and is protected with the best encryption software in the industry - SSL (Secure Socket Layers), provided by Thawte, the premier encryption software company available today. While on a secure page such as our order form, the lock icon on the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to unlocked, or open, when you are just 'surfing'.

While we use SSL encryption to protect sensitive information online, we also do everything in our power to protect user-information offline. All of our users' information, like the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example, a customer service representative) are granted access to personally identifiable information. If one of these people leaves their workstation, they are required to lock their station until they return. Furthermore, ALL employees are kept up to date on our security and privacy practices.

Every quarter, as well as any time new policies are added, our employees are notified and/or reminded about the importance of keeping our customers' information secure and safe at all times. Finally, the servers that we store personally identifiable information on are kept in a locked and secure environment.

LK Online Terms and Conditions (The Legal Jargon!)

1.DEFINITIONS

1.1. The following definitions apply to these terms and conditions:
“Customer” means a person who applies for permission to order goods via this website.
“Service” means the delivery of goods from Liquor King’s physical stores in response to orders placed by registered Customers via this website and in accordance with these Terms and Conditions.

2. WEBSITE

2.1. Terms and Conditions binding

The Customer, by applying for permission to order goods via this website, or by placing an order via this website, represents that he/she has read, understood and accepted these terms and conditions and those elsewhere on this website and agrees to be bound by them.

2.2. Modification of website

Liquor King may at any time, modify any of the material contained on this website, including these terms and conditions, without prior notice. Notification of such modifications will be posted on this website. Continued use or the placing of an order by the Customer after a notification is made constitutes acceptance by the Customer of the modifications.

3. SERVICE

3.1. Service “as is”

The Service is provided “as is”, and Liquor King disclaims ALL warranties and conditions, whether expressed or implied with regard to this site and/or any associated sites and/or any associated stores and/or any other service, including but not limited to delivery, including any implied conditions of merchantability, fitness for a particular purpose, title and non-infringement.

3.2. Changes to Service

The Customer understands that Liquor King and its employees or agents may, at any time, for any reason and without notice make improvements and/or changes to the Service whether on-line or in relation to any service related to this site.

3.3. Termination of Service

Liquor King reserves the right, and has absolute discretion to, at any time and for any reason whatsoever, terminate all or part of any service supplied by Liquor King and/or its agents and/or its delivery persons to any Customer, with or without notice, effective immediately.

4. REGISTRATION

4.1. Customer information and privacy

4.1.1 Sufficient information must be supplied – In applying for registration it is the Customer’s responsibility to supply Liquor King with sufficient personal information. Liquor King is entitled to deny an application for registration due to insufficient information supplied by the Customer, where Liquor King considers such information is important and is reasonably obtainable by that Customer.

4.1.2 Collection of information from other sources - The Customer hereby authorises Liquor King to access any personal information about the Customer from any source including but not limited to: · The Customer; · The Customer’s present banks and/or financial institutions (for the sole purpose of ascertaining creditworthiness; · Credit referral agencies (for the sole purpose of ascertaining creditworthiness); · Other suppliers of products and services (in relation to business customers only); · People or companies who are or have been associated with the Customer, with the Customer’s consent.

4.1.3 Use - Any information collected by Liquor King will be used to determine or confirm Customer details and/or to ensure that the Customer’s application is satisfactory to Liquor King.

4.1.4 Access/Disclosure - The Customer authorises Liquor King’s employees, agents, suppliers or delivery people for the purpose of the performance of the Agreement to access any information supplied by the Customer or collected by Liquor King and accepts that such information may be forwarded on to a credit referral agency.

4.2. Acceptance

4.2.1 Confirmation –Liquor King will advise the Customer of whether or not their application has been accepted.

4.2.2 Right to refuse registration - Liquor King has the right to refuse registration of a Customer or terminate the registration of a Customer at its sole discretion and for any reason whatsoever. The Customer acknowledges that Liquor King is not obliged to disclose the reason for any such refusal or termination.

4.2.3 Validation of credit card required- Acceptance of any order placed through this site is conditional on validation of the Customer's credit card number and approval of the purchase amount by the card issuer.

5. CUSTOMER'S PASSWORDS

5.1. Customer to receive password – Where the Customer’s application for registration is accepted by Liquor King, the Customer shall be issued with a password that must be used when placing orders.

5.2. Customer to keep password confidential - The Customer is solely responsible for maintaining the confidentiality of the Customer’s password. The Customer must not disclose the Customer’s password to any third party at any time for any reason whatsoever. If the password is disclosed to any third party at any time for any reason, then the Customer is liable for any consequences. The Customer undertakes to notify Liquor King of any such disclosure and arrange to alter the password immediately.

5.3. Customer liable for orders - The Customer is liable for every order made through or in relation to this website using their password and/or account.

5.4. Customer to indemnify Liquor King - The Customer indemnifies Liquor King and the Lion Nathan family of companies and their agents against any claims or damages arising from the misuse of the Customer's account whatsoever.

6. DELIVERY

6.1. Timing of delivery - Liquor King will endeavour to deliver all normal orders within a reasonable time. However, the Customer accepts that delays may arise in some circumstances, for instance where credit card details or delivery details are incomplete or incorrect, where credit card authorisation is refused, or where the order includes unusual requests.

6.2. Identity check of recipient - The Customer warrants and understands that it is the Customer’s responsibility to establish that the person or persons receiving the goods (“the Recipient”) shows current identification of the Recipient to the person or persons delivering the goods. The identification must include the Recipient’s: · Full name; · Date of birth; · Photo; and · Signature.

6.3. Where this information is not available on one piece of identification, further identification must be provided by the Customer to fulfil the above requirements.

6.4. Non-delivery - If the goods cannot be delivered for any reason, such as the Customer failing or refusing to accept the goods, or the Recipient failing to produce adequate identification, the goods will be returned to the store that is the origin of the goods and held for the Customer to collect. The Customer must, at the customer’s expense, collect the goods within one week of the attempted delivery.

6.5. Obligations complete on delivery - Liquor King is deemed to have fulfilled its obligations upon delivery of the goods.

7. WARRANTIES

7.1. Exclusion of certain warranties etc - Liquor King expressly excludes all expressed or implied warranties, descriptions, representations, statements and advice, other than those provided in the Consumer Guarantees Act 1993, given as to the fitness or suitability for any purpose, tolerance to any conditions, similarity to sample, merchantability or otherwise. Liquor King shall not be bound or responsible for any such unauthorised: warranties; and/or descriptions; and/or representations; and/or statements; and/or advice, made by any of its employees, agents, suppliers or delivery people, whether made in good faith or otherwise.

7.2. Consumer Guarantees Act – Where the Customer is not a “Consumer” as defined in the Consumers Guarantees Act 1993, or where the Customer holds him or herself out as acquiring the goods for the purposes of business then the provisions of the Consumer Guarantees Act 1993 shall not apply.

7.3. Risk to pass to Customer - The Customer accepts and acknowledges that regardless of any advice given by an employee, agent, supplier or delivery person, that upon acceptance of the goods by the Customer, all risk in the goods passes to the Customer.

7.4. Product Liability - Liquor King excludes all liability against any damage and/or injury and/or loss arising directly or indirectly from any defect in or non-compliance of the goods. The Customer acknowledges and accepts that any damages for any other breach of Liquor King’s obligations shall not in any event exceed an amount equivalent to the price of the goods.

7.5. Customer’s agents and third parties - The Customer accepts and acknowledges that Liquor King is not liable or responsible for any damage and/or injury and/or loss arising from the Customer’s servants, agents, buyers or any other persons.

7.6. General disclaimer - Notwithstanding the above paragraphs, Liquor King shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever arising out of use of this website or the Service.

8. FORCE MAJEURE

8.1. Liquor King shall be under no liability - to the Customer in respect of anything that, if not for this provision, would or might constitute a breach of this Agreement, where this arises out of circumstances beyond the control of Liquor King, including but not limited to acts of God; natural disasters; sabotage; accident; riot; shortage of supplies, equipment, materials; strikes and lockouts; civil commotion; computer hacking; or malicious damage.

9. ENTIRE AGREEMENT

9.1. These terms and conditions constitute- the entire agreement between Liquor King and the Customer and supersedes all prior representations, agreements, statements and understandings, whether verbal or in writing, relating to this website or the Service, with the exception of the Liquor King Standard Terms and Conditions of Sale which shall remain in full force and effect except where it conflicts with these Terms and Conditions, in which case these Terms and Conditions shall prevail.

10. JURISDICTION

10.1. New Zealand Jurisdiction - This agreement and all issues arising from or in relation to this site are governed and shall be construed in accordance with the laws of New Zealand and the parties agree to submit to the exclusive jurisdiction of the High Court of New Zealand.

10.2. Customer to abide by applicable laws - Without limiting the above clause, any Customer placing an order from another jurisdiction thereby represents that their doing so does not breach any law of that Jurisdiction and agrees to indemnify Liquor King against any action brought by any party in respect of that order.

11. ALL RIGHTS RESERVED

11.1. Liquor King reserves all rights not expressly granted by this agreement.
 

LK Bar Tab Terms & Conditions

By submitting a signed application form and/or using the Liquor King (LK) customer loyalty programme (LK Bar Tab), you the LK Bar Tab member, agree to be bound by the following terms and conditions, as may be amended from time to time:

1. Only individuals over the age of 18 years of age can apply for a LK Bar Tab membership. To apply for a LK Bar Tab membership, a completed and signed application form must be returned to LK in store or submitted online with your online registration. If your application is accepted you will receive a LK Bar Tab loyalty card, which can be used to collect points for your LK Bar Tab. You may purchase an upgrade to an all metal card in store at the current retail price. You may hold only one (1) LK Bar Tab membership and/or loyalty card at any time. LK is entitled at its discretion not to accept an application or issue a loyalty card upon receiving a completed application form.

2. LK Bar Tab points are only earned on retail transactions at LK’s advertised pricing, including promotional pricing. Trade and corporate customers do not qualify for LK Bar Tab points. Cigarettes, tobacco, gift voucher and gift card purchases are excluded from earning LK Bar Tab points

3. All LK Bar Tab loyalty cards and LK Bar Tab rewards provided by LK (once the required number of points has been earned) remain the property of LK. LK may cancel any LK Bar Tab membership and/or loyalty card at any time at its sole discretion.

4. You will be awarded one (1) LK Bar Tab point for every qualifying incremental purchase of $10.00. This means that for purchases totalling $10.00 to $19.99 one (1) point will be earned, for purchases from $20.00 to $29.99, two (2) points will be earned, and so on. In addition, for purchases totalling $75.00 or more five (5) bonus points will be earned. A valid LK Bar Tab loyalty card must be presented at the time of purchase in order to qualify for points.

5. Once you have accumulated 100 LK Bar Tab points you will be entitled to redeem rewards from your LK Bar Tab to the value of $15.00. Rewards must be redeemed for product at LK, no change will be tendered.

6. LK Bar Tab points can be earned at all LK stores and online at www.lk.co.nz. LK Bar Tab points are non-transferable and have no monetary value and the associated LK Bar Tab rewards are non-transferrable.

7. A LK Bar Tab points and rewards balance enquiry is available at all LK stores and online at www.lk.co.nz (your balance may take up to 48 hours to update).

8. LK is not responsible for stolen or lost cards or rewards associated with any LK vouchers. Replacement metal cards will be charged at the current retail price.

9. Employees of LK and any other member of the Lion Nathan group of companies are prohibited from participating in the LK Bar Tab loyalty programme.

10. LK is not responsible for any errors relating to the value of any LK Bar Tab points or rewards balance resulting from computer hardware or software errors or failure, or as a result of fraud.

11. LK excludes all responsibility and liability to the fullest extent permitted by law in relation to the LK Bar Tab loyalty programme. Where any such liability cannot be excluded, LK's maximum liability to you under this agreement will be limited to NZ$100.

12. LK Bar Tab points cannot be earned in conjunction with other points/loyalty schemes with the exception of credit card payment schemes.

13. LK Bar Tab points have an expiry date of 36 months from the date they are earned.

14. LK reserves the right to change the reward to reward point ratio. If such change is made a minimum of one months notice will be given.

15. LK reserves the right to discontinue the LK Bar Tab customer loyalty programme, upon giving you three months notice of discontinuation. An LK voucher will be provided to you for any rewards owing if the required points balance is earned prior to the discontinuation date within six months of the discontinuation date. All rewards associated LK vouchers must be redeemed prior to the expiry date printed on the LK voucher.

16. In case of dispute with you regarding the LK Bar Tab customer loyalty programme, the decision of LK shall be final and binding.

17. LK does not accept the presentation of your LK Bar Tab loyalty card as a proof of age identification. LK reserves the right to request age verification if you are a LK Bar Tab loyalty member.
